1. Acceptance of These Terms
These Terms of Use (the "Terms") govern your access to and use of the website located at https://pilr.ai and its sub-pages (the "Site"), operated by 9533-1518 Québec inc., doing business as Pilr Inc. ("Pilr," "we," "our," or "us").
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not access or use the Site.
These Terms apply to the Site only. They do not govern any product, application, or service offered by Pilr through a separate website or platform, including le topo (see Section 9).
2. Eligibility
You must have the legal capacity to enter into a binding agreement in your jurisdiction in order to use the Site. By using the Site, you confirm that you meet this requirement. If you use the Site on behalf of an organization, you confirm that you are authorized to accept these Terms on its behalf.
3. Informational Purpose Only
The Site is an informational and marketing website about Pilr and what it does. Its content is provided for general information purposes only.
Nothing on the Site constitutes, and nothing on the Site should be relied on as, professional advice of any kind — including real-estate, brokerage, valuation, appraisal, legal, financial, tax, investment, or accounting advice. The Site does not provide real-estate analyses, reports, due-diligence services, or any similar professional service. You should obtain advice from a qualified professional before making any decision based on information you find on the Site.
We may change, suspend, or discontinue any part of the Site at any time without notice. We do not guarantee that the Site or its content will always be available, current, complete, or error-free.
4. Intellectual Property
The Site and its contents — including text, graphics, images, page layouts, designs, logos, and the selection and arrangement of content — are owned by Pilr or its licensors and are protected by applicable intellectual property laws.
The name "Pilr," the Pilr logo, the "le topo" name and logo, and any related names, marks, and slogans are trademarks of Pilr or its licensors (whether or not registered). You may not use any of these marks without our prior written permission.
We grant you a limited, revocable, non-exclusive, non-transferable permission to access and view the Site for your own personal or internal business information purposes. This permission transfers no ownership or other rights to you. All rights not expressly granted are reserved.
5. Permitted Use
You may access and use the Site only for lawful purposes and in accordance with these Terms. You may view, and make a reasonable number of copies of, pages of the Site for your own personal or internal business reference, provided you do not remove or alter any copyright, trademark, or other proprietary notices.
6. Prohibited Conduct
You agree not to, and not to attempt to:
- use the Site in any way that violates any applicable law or regulation, or for any unlawful or fraudulent purpose;
- copy, reproduce, republish, distribute, sell, license, or otherwise commercially exploit any part of the Site, except as expressly permitted in Section 5;
- scrape, crawl, harvest, "data mine," or use any automated means or bot to access, monitor, or copy the Site or its content without our prior written consent;
- reverse engineer, decompile, or disassemble any part of the Site, except to the extent this restriction is prohibited by applicable law;
- introduce any virus, malware, or other harmful code, or otherwise interfere with, disrupt, overload, or impair the Site, its servers, or connected networks;
- attempt to gain unauthorized access to any part of the Site, or circumvent any security or access-control measure (including the bot protection on the contact form);
- frame, mirror, or incorporate any part of the Site into another website or service without our prior written consent;
- misrepresent your identity or affiliation, or impersonate any person or entity; or
- use the contact form, or any other communication feature, to send spam, advertising, harassing or abusive content, any unsolicited or unlawful communication, or false or misleading information.
7. Contact-Form Submissions
The Site offers a contact form through which you may send us your first name, last name (optional), email address, company (optional), and a message. Use of the contact form is voluntary. Our handling of the personal information you submit is described in our Privacy Policy (see Section 12).
Please do not send us confidential, sensitive, or proprietary information through the contact form, and do not include personal information about other people without their authorization. Submissions are not made under any obligation of confidentiality, and no confidential or fiduciary relationship is created by your sending, or our receiving, a submission.
By submitting a message, you grant Pilr the right to use, store, copy, and act on the information you send for the purpose of reviewing your message, responding to you, and keeping a record of the communication. You confirm that the information you provide is accurate and that you are entitled to provide it. We are not obligated to respond to, or to retain, any submission.
8. Third-Party Links
The Site may contain links to websites, resources, or services operated by third parties. We provide these links for convenience only. We do not control, endorse, or assume responsibility for any third-party website or its content, products, services, or privacy practices. Your use of any third-party website is at your own risk and is governed by that third party's own terms and policies.
9. le topo and Other Pilr Products
le topo is a separate product offered by Pilr through a separate website and platform. The le topo product, website, and platform are not governed by these Terms. They are governed by le topo's own terms of use and privacy policy.
If you access le topo — including through any link on the Site — you do so under those separate terms and policies, and you should review them before using that product. These Terms do not create any right to access or use le topo, and they do not address subscriptions, accounts, service levels, or the processing of any data within the le topo product.
10. Disclaimer of Warranties
The Site and all content on it are provided "as is" and "as available," without warranty of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by applicable law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the Site will be uninterrupted, secure, accurate, current, complete, or free of errors or harmful components.
Some jurisdictions, including Québec, do not allow the exclusion of certain warranties or legal guarantees. To the extent any such warranty or guarantee cannot be excluded under applicable law, the exclusions in this Section apply only to the extent permitted by that law, and nothing in these Terms limits any right or guarantee you may have that cannot be limited or excluded by law.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Pilr and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business, or goodwill, arising out of or relating to your access to or use of, or inability to access or use, the Site or its content, whether based on contract, extra-contractual liability (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, our total aggregate liability arising out of or relating to the Site or these Terms will not exceed one hundred Canadian dollars (CAD $100).
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
12. Privacy
Your use of the Site is also subject to our Privacy Policy, available at https://pilr.ai/privacy-policy, which describes how we collect, use, and protect personal information in connection with the Site. By using the Site, you acknowledge that you have read the Privacy Policy.
13. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Pilr and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your breach of these Terms, your misuse of the Site, or your violation of any applicable law or the rights of any third party.
14. Changes to These Terms
We may revise these Terms from time to time. The revised Terms will be posted on this page with an updated "Last updated" date and will take effect when posted. Your continued use of the Site after the revised Terms take effect constitutes your acceptance of them. We encourage you to review these Terms periodically.
15. Governing Law and Jurisdiction
These Terms, and any dispute arising out of or relating to these Terms or the Site, are governed by the laws of the Province of Québec and the federal laws of Canada applicable in Québec, without regard to conflict-of-laws principles.
You agree that the courts of the Province of Québec (judicial district of Montréal) have exclusive jurisdiction over any such dispute, subject to any mandatory right you may have under applicable law to bring proceedings in another forum.
16. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Pilr regarding your use of the Site, and supersede any prior agreements or understandings on that subject. Our failure to enforce any provision is not a waiver of that provision.
18. Language
It is the express wish of the parties that these Terms and all related documents be drawn up in English. Les parties ont exigé que la présente convention et tous les documents qui s'y rattachent soient rédigés en français.
These Terms are also available in French. In case of discrepancy between the two versions, the French version prevails.
